Tampa Defense Attorney on Constructive Possession

Tampa Defense Attorney notes a recent case where the evidence was insufficient to establish that defendant had control over paraphernalia containing cocaine residue found on table in a hotel room. The court ruled that the State had only established that the defendant was nothing more than visitor of a resident of the room. The defendant, the Appeals Court ruled, should have been acquitted by the Court. The elements of Constructive Possession had not been proven.
