Criminal Defense Expert in Tampa notes recent appeals court ruling - Florida court rules that the extended delay while writing a citation after traffic stop for excessive speed was grounds for suppressing cocaine. Facts - Drug Dog alerted on vehicle after officer detained defend ant for almost (30) thirty minutes before issuing citation. Notably, the  search did not begin until after citation was issued. Ruling - Without an articulable suspicion of criminal activity a traffic stop should last no longer than is necessary to make any required license or registration checks and to write the citation. Once completed, a traffic stop cannot be extended to conduct a drug dog sniff search, even if the delay is brief or "de minimus."
