Inconsistent Cannabis Verdict Overturned
Tampa Drug Attorney, Lawyer W.F. ''Casey'' Ebsary Jr. just received a report of an interesting Possession of Cannabis decision in a Florida appeals court. After the trial, there appeared to be Inconsistent verdicts. A Jury verdict in trafficking in cannabis charge, found that defendant was not guilty of possessing more than 25 pounds of cannabis. The jury then found the defendant not guilty of possessing between 20 grams and 25 pounds of cannabis. The final straw, the jury concluded that the defendant was not even guilty of possessing less than 20 grams of cannabis. The appeals court concluded that these three not guilty results were inconsistent with a guilty verdict in one count that alleged possession by possessing more than 20 grams of cannabis. The court then reversed the conviction for possession of cannabis.
